REGULAMIN SKLEPU I ŚWIADCZENIA USŁUG

§1. POSTANOWIENIA OGÓLNE

1. Właścicielem serwisu działającego pod adresem www.oksanapavlii.com jest JDG Oksana Pavlii, NIP: 6793285100, e-mail: pavliyoksana@gmail.com

2. Regulamin określa zasady sprzedaży produktów cyfrowych oraz rezerwacji i uczestnictwa w sesjach energetycznych (indywidualnych i grupowych).

§2. NATURA USŁUG I ODPOWIEDZIALNOŚĆ

1. Charakter pracy: Sesje (m.in. Aktywacja Energii Kundalini) są procesami o charakterze duchowym i energetycznym. Nie są one formą psychoterapii, poradnictwa psychologicznego ani leczenia medycznego.

2. Gotowość klienta: Przystępując do sesji, Klient deklaruje, że jego stan zdrowia psychicznego i fizycznego pozwala na udział w procesie. Klient bierze pełną odpowiedzialność za swoje doświadczenia oraz ich integrację po spotkaniu.

3. Przeciwwskazania: Udział w sesjach nie jest zalecany osobom w ciąży (szczególnie III trymestr), osobom z epilepsją, aktywnymi chorobami psychicznymi (np. schizofrenia, choroba dwubiegunowa) lub osobom pod wpływem środków psychoaktywnych. Sprzedawca ma prawo odmówić przeprowadzenia sesji, jeśli uzna, że istnieją ku temu przeciwwskazania.

§3. REZERWACJE I PŁATNOŚCI

1. Płatności obsługiwane są przez system Stripe. Rezerwacja sesji jest wiążąca w momencie dokonania płatności.

2. Dowodem zakupu jest automatyczne potwierdzenie (Receipt) wysyłane przez Stripe. Faktury VAT wystawiane są na życzenie Klienta po przesłaniu danych na e-mail: pavliyoksana@gmail.com

3. Pakiety: Pakiety sesji są imienne i mają określony termin ważności 6 miesięcy.

§4. REZYGNACJE, ZWROTY I TERMINY

1. Sesje Indywidualne: Zmiana terminu lub rezygnacja jest możliwa bezpłatnie do 24 godzin przed spotkaniem. W przypadku odwołania sesji na mniej niż 24h przed terminem, płatność nie podlega zwrotowi (koszt rezerwacji czasu i gotowości).

2. Sesje Grupowe / Eventy: Płatność nie podlega zwrotowi. .

3. Zwroty: Zwrot środków następuje wyłącznie w przypadku odwołania wydarzenia przez Organizatora.

§5. DOSTAWA TREŚCI CYFROWYCH I PRAWO ODSTĄPIENIA

1. Produkty cyfrowe (e-booki, kursy) są udostępniane niezwłocznie po opłaceniu przez platformę Podia.

2. Klient przyjmuje do wiadomości, że uzyskując natychmiastowy dostęp do treści cyfrowych, traci prawo do odstąpienia od umowy (zgodnie z art. 38 pkt 13 ustawy o prawach konsumenta).

§6. SPRAWY TECHNICZNE I POUFNOŚĆ

1. Sesje Online: Klient odpowiada za stabilne łącze internetowe, sprawną kamerę i mikrofon. Jeśli sesja nie dojdzie do skutku z przyczyn technicznych leżących po stronie Klienta, uznaje się ją za odbytą.

2. Poufność: Treści poruszane podczas sesji indywidualnych są objęte pełną poufnością.

3. Wizerunek: Uczestnicząc w sesji grupowej online, Klient wyraża zgodę na jej nagrywanie (wizerunek może być widoczny dla innych uczestników grupy lub subskrypcji).

§7. REKLAMACJE I POSTANOWIENIA KOŃCOWE

1. Reklamacje należy zgłaszać na adres: pavliyoksana@gmail.com Zostaną rozpatrzone w ciągu 14 dni.

2. Dokonując rezerwacji lub zakupu, Klient potwierdza, że zapoznał się z niniejszym Regulaminem i akceptuje jego postanowienia.

REGULAMIN UCZESTNICTWA W WYJEŹDZIE WARSZTATOWYM

§1. CHARAKTER WYJAZDU I ROLA ORGANIZATORKI

1. Wyjazd ma charakter warsztatowo-rozwojowy i edukacyjny. Organizatorka (JDG) zapewnia program merytoryczny oraz koordynację logistyki na miejscu.

2. Organizatorka nie jest biurem podróży w rozumieniu Ustawy o imprezach turystycznych. Nie pośredniczy w zakupie biletów lotniczych ani nie świadczy usług ubezpieczeniowych.

3. Uczestnik bierze udział w wyjeździe na własną odpowiedzialność, potwierdzając, że jego stan zdrowia pozwala na podróż do Indii.

§2. REZERWACJA I ZASADY PŁATNOŚCI

1. Gwarancją rezerwacji miejsca jest wpłata bezzwrotnego zadatku.

2. Zadatek stanowi zabezpieczenie kosztów rezerwacji lokalnych kontrahentów (hotele, transport) i w przypadku rezygnacji Uczestnika nie podlega zwrotowi.

3. Pozostała kwota płatna jest gotówką w EUR w pierwszym dniu Retreatu w Ośrodku u Organizatorki. Nieuregulowanie tej kwoty jest równoznaczne z rezygnacją z udziału w wyjeździe bez zwrotu zadatku.

§3. FORMALNOŚCI (PASZPORT, WIZA, DOJAZDY, LOTY)

1. Uczestnik zobowiązany jest posiadać paszport ważny co najmniej 6 miesięcy od daty wjazdu do Indii.

2. Samodzielne uzyskanie e-wizy turystycznej oraz pokrycie jej kosztu (ok. 25-80 USD w zależności od typu) leży po stronie Uczestnika. Organizatorka przesyła instrukcję pomocniczą, ale nie odpowiada za decyzje urzędów imigracyjnych Indii.

3. Zakup biletu lotniczego jest obowiązkiem Uczestnika. Organizatorka nie odpowiada za opóźnienia, odwołane loty lub zgubiony bagaż przez linie lotnicze.

§4. UBEZPIECZENIE I BEZPIECZEŃSTWO

1. Uczestnik ma obowiązek wykupić indywidualne ubezpieczenie KL (koszty leczenia) i NNW (następstwa nieszczęśliwych wypadków) ważne na terytorium Indii na cały okres wyjazdu.

2. Uczestnik zobowiązuje się do przestrzegania lokalnego prawa oraz zasad bezpieczeństwa przedstawionych przez Organizatorkę.

3. Organizatorka zastrzega sobie prawo do zmiany kolejności punktów programu ze względu na czynniki zewnętrzne (pogoda, sytuacja polityczna, opóźnienia lokalnego transportu), dbając o zachowanie pełnej wartości merytorycznej wyjazdu.

§5. ZACHOWANIE I WYKLUCZENIE Z GRUPY

1. W trosce o komfort grupy, Organizatorka zastrzega sobie prawo do wykluczenia Uczestnika z wyjazdu (bez zwrotu kosztów), jeśli jego zachowanie w sposób rażący narusza spokój grupy, jest agresywne lub zagraża bezpieczeństwu innych osób.

§6. ZNISZCZENIA W MIEJCU ZAKWATEROWANIA

1. Uczestnik ponosi pełną odpowiedzialność finansową za ewentualne szkody wyrządzone przez niego w miejscach zakwaterowania.

TERMS AND CONDITIONS OF SERVICES AND DIGITAL PRODUCTS PURCHASE

§1. GENERAL PROVISIONS

1. The owner of the website operating at www.oksanapavlii.com is JDG Oksana Pavlii, NIP: 6793285100, e-mail: pavliyoksana@gmail.com

2. These Terms and Conditions define the rules for using the online store, purchasing digital products (Digital Content), and booking as well as participating in energy sessions (individual and group).

3. A Customer may be any natural person, legal person, or organizational unit with full legal capacity.

§2. NATURE OF SERVICES AND LIABILITY

1. Nature of Work: Sessions (including Kundalini Activation Process) are spiritual and energetic processes. They are NOT a form of psychotherapy, psychological counseling, or medical treatment.

2. Customer Readiness: By joining a session, the Customer declares that their mental and physical health allows for participation in the process. The Customer takes full responsibility for their experiences and their integration after the meeting.

3. Contraindications: Participation in sessions is not recommended for pregnant women (especially in the 3rd trimester), people with epilepsy, active mental illnesses (e.g., schizophrenia, bipolar disorder), or persons under the influence of psychoactive substances. The Seller reserves the right to refuse a session if contraindications are identified.

§3. RESERVATIONS AND PAYMENTS

1. Payments are processed via the Stripe system. A session reservation becomes binding at the moment of payment.

2. The proof of purchase is an automatic confirmation (Receipt) sent by Stripe. VAT invoices are issued upon the Customer's request after sending company details to: oksanapavliy@gmail.com

3. Packages: Session packages are personal (non-transferable) and have 6 months of expiry date.

§4. CANCELLATIONS, REFUNDS, AND RESCHEDULING

1. Individual Sessions: Rescheduling or cancellation is possible free of charge up to 24 hours before the meeting. If a session is cancelled less than 24 hours before the scheduled time, the payment is non-refundable (it is treated as a fee for the reservation of the Seller's time and readiness).

2. Group Sessions / Events: Payments are non-refundable. In case of absence.

3. Refunds: Refunds for paid services occur only in the event of the cancellation of the event by the Organizer.

§5. DELIVERY OF DIGITAL CONTENT AND RIGHT OF WITHDRAWAL

1. Digital products (e-books, courses) are made available immediately after payment via the Podia platform.

2. The Customer acknowledges that by gaining immediate access to digital content, they lose the right of withdrawal from the agreement (in accordance with EU consumer law regarding digital goods).

§6. TECHNICAL MATTERS AND CONFIDENTIALITY

1. Online Sessions: The Customer is responsible for a stable internet connection and a working camera and microphone. If a session does not take place due to technical issues on the Customer's side, it is considered completed.

2. Confidentiality: All topics discussed during individual sessions are strictly confidential.

3. Image Rights: By participating in an online group session, the Customer consents to its recording (the Customer's image may be visible to other participants of the group or subscription).

§7. COMPLAINTS AND FINAL PROVISIONS

1. Complaints should be sent to: pavliyoksana@gmail.com They will be reviewed within 14 days.

2. By making a reservation or purchase, the Customer confirms that they have read and accepted these Terms and Conditions.

TERMS AND CONDITIONS OF PARTICIPATION IN THE WORKSHOP RETREAT

§1. NATURE OF THE TRIP AND ROLE OF THE ORGANIZER

1. The trip is of a workshop-developmental and educational nature. The Organizer (sole proprietorship/JDG) provides the substantive program and coordinates on-site logistics.

2. The Organizer is not a travel agency within the meaning of the Act on Package Travel and Linked Travel Arrangements. She does not act as an intermediary in the purchase of airline tickets nor does she provide insurance services.

3. The Participant takes part in the trip at their own risk, confirming that their state of health allows for travel to India.

§2. RESERVATION AND PAYMENT TERMS

1. The guarantee of a reserved spot is the payment of a non-refundable deposit in the amount of 30% of the trip value.

2. The deposit serves as security for the reservation costs of local contractors (hotels, transport) and is non-refundable in the event of the Participant's cancellation.

3. The remaining amount (70%) is payable in cash in USD at the airport in India immediately upon arrival. Failure to settle this amount is equivalent to resignation from participation in the trip without a refund of the deposit.

   §3. FORMALITIES (PASSPORT, VISA, TRAVEL, FLIGHTS)

1. The Participant is obliged to hold a passport valid for at least 6 months from the date of entry into India.

2. Obtaining a tourist e-Visa independently and covering its cost (approx. 25-80 USD depending on the type) is the responsibility of the Participant. The Organizer sends helpful instructions, but is not responsible for the decisions of the Indian immigration authorities.

3. The purchase of an airline ticket is the Participant's obligation. The Organizer is not responsible for delays, canceled flights, or luggage lost by the airlines.

§4. INSURANCE AND SAFETY

1. The Participant is obliged to purchase individual medical expense insurance (KL) and personal accident insurance (NNW) valid in India for the entire duration of the trip.

2. The Participant undertakes to comply with local laws and safety rules presented by the Organizer.

3. The Organizer reserves the right to change the order of program points due to external factors (weather, political situation, delays in local transport), while ensuring the full substantive value of the trip is maintained.

§5. BEHAVIOR AND EXCLUSION FROM THE GROUP

1. Out of concern for the comfort of the group, the Organizer reserves the right to exclude a Participant from the trip (without a refund of costs) if their behavior grossly violates the peace of the group, is aggressive, or threatens the safety of others.

§6. DAMAGES AT THE ACCOMMODATION

1. The Participant bears full financial responsibility for any damage caused by them at the accommodation sites.
